Terms of service.

Welcome to Ponder. These Terms and Conditions (“Terms”) govern your access to and use of the Ponder mobile app, web app, website, and related services (together, “the Service”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Ponder.
1. Who We Are
Ponder is operated by PONDERCPD PTY LTD (ABN 54 693 746 422), (ACN 693 746 422) trading as Ponder (“we”, “our”, “us”).

Ponder is built and hosted in Australia.
2. Use of the Service
The Service is designed for registered psychologists in Australia to plan, record, and export Continuing Professional Development (“CPD”) activities.
You are responsible for ensuring the accuracy and completeness of your CPD records and for meeting the professional standards set by the Psychology Board of Australia (PsyBA).
When using Ponder, you agree that you will:
Use the platform only for lawful and professional purposes.
Enter only non-identifiable, professional development-related information.
Maintain confidentiality and comply with your professional and ethical obligations.
You must not:
Enter, upload, or store identifiable client information, including client names, dates of birth, addresses, or contact details.
Upload confidential or sensitive client materials.
Attempt to copy, reverse-engineer, or gain unauthorised access to the Service.
Use the Service to distribute malware, spam, or unlawful content.
When recording supervision notes or reflections, you must use pseudonyms, initials, or non-identifiable information only.
Ponder is a tool to assist with CPD planning and logging. It does not provide professional advice or guarantee regulatory compliance. Psychologists remain responsible for ensuring their own CPD activities and records meet PsyBA requirements.
3. Accounts and Security
You must provide accurate information when creating an account and keep your login credentials secure.
You are responsible for all activity under your account.
If you suspect unauthorised access or any breach of security, please notify us immediately at contact@pondercpd.com.
4. Subscriptions, Trials, and Payments
Ponder may offer a free trial for new users. Details of the trial length and included features will be displayed during sign-up.
After your trial ends, continued access requires an active paid subscription.
Payments are processed securely through third-party providers such as Stripe, Apple App Store, or Google Play. Ponder does not store your payment details.
Subscriptions renew automatically unless cancelled before the renewal date. You will always be notified of upcoming renewals or pricing changes before they take effect.
You may cancel your subscription at any time through your account settings. Refunds are handled in accordance with Australian Consumer Law.
5. Data Ownership and Use
You own all CPD content and data that you upload to Ponder.
By using the Service, you grant us a limited licence to store, process, and back up your data solely for the purpose of operating and improving the Service.
Your data is hosted securely in Australia.
If you delete your account or your subscription lapses, we will:
Generate and email you an export of your CPD records; and
Permanently delete your account and all associated data 30 days after the export, except where retention is required by law.
6. Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, and how we protect it.
By using Ponder, you consent to that policy.
Our Privacy Policy forms part of these Terms. A breach of the Privacy Policy may also be considered a breach of these Terms.
7. Intellectual Property
All software, design, text, graphics, logos, and other materials in the Service are the property of PONDERCPD PTY LTD (trading as Ponder) or its licensors.
You may not reproduce, modify, distribute, or create derivative works from any part of Ponder without our prior written consent.
8. Service Availability and Changes
We aim to provide reliable and secure access to Ponder but do not guarantee uninterrupted service.
Downtime, maintenance, or third-party service outages (e.g., hosting or payment providers) may occasionally affect availability. We are not liable for interruptions beyond our reasonable control.
We may update, modify, or discontinue features at any time. If a change materially affects your use, we will notify you by email or within the app.
9. Limitation of Liability
Ponder is provided on an “as is” basis.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss — including loss of data, revenue, or failure to meet professional requirements — arising from your use of the Service.
Nothing in these Terms limits your rights under Australian Consumer Law.
10. Termination
You may stop using Ponder at any time through your account settings.
We may suspend or terminate access if you:
Breach these Terms;
Misuse the Service; or
Are required by law to cease access.
Upon termination, your data will be handled in accordance with Section 5 (Data Ownership and Use).
11. Governing Law
These Terms are governed by the laws of Western Australia.
Any disputes will be heard in the courts of that jurisdiction.

By using Ponder, you agree to use it responsibly and understand that while we help you stay organised and audit-ready, maintaining compliance with PsyBA requirements and protecting client confidentiality remains your responsibility.
